Acceptance of Terms

By registering for or using ShimmyGen (the “Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use the Service.

Eligibility

You must be at least 13 years old to use the Service. By registering, you represent that you meet this age requirement.

Accounts

• You are responsible for maintaining the confidentiality of your account and password.
• You agree to provide accurate and complete information during registration and to keep it up to date.
• You are responsible for all activities that occur under your account.

Use of the Service

• The Service is provided for personal, non-commercial use only.
• You may not use the Service for unlawful purposes or to transmit any harmful, abusive, or disruptive content.
• We reserve the right to suspend or terminate accounts that violate these Terms.

Intellectual Property & Commercial Use

All content, materials, designs, features, and intellectual property made available through the Service are owned exclusively by ShimmyGen / Dragonfreelance, unless otherwise indicated. Unauthorized commercial use of the Service, including but not limited to creating derivative works, reselling content, or using the Service to generate revenue, constitutes a material breach of these Terms. In such cases, we reserve the right to:

• Terminate your account immediately without refund;
• Seek injunctive relief to prevent further use;
• Recover all profits earned by you from such unauthorized use; and
• Pursue damages, attorneys’ fees, and any other remedies available under law.

By using the Service, you acknowledge that all profits derived from unauthorized commercial use of our intellectual property are the rightful property of ShimmyGen / Dragonfreelance and agree to transfer such profits to us upon demand.

Termination

We may suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the Service.

Disclaimers

The Service is provided on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, ShimmyGen, Arcanum Dance, Drake, and Kamrah shall not be liable for any indirect, incidental, consequential, or punitive damages, or for loss of profits or revenues, arising from your use of the Service.

Indemnification

You agree to indemnify and hold harmless ShimmyGen, Arcanum Dance, Drake, and Kamrah from any claims, damages, liabilities, and expenses arising from your use of the Service or your violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of Illinois, United States. You agree to submit to the exclusive jurisdiction of the courts located in Illinois for any disputes.

Changes to the Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
